1. ACCEPTANCE OF TERMS

By accessing or using Aatma Medical Marijuana Evaluation's services (including our website, patient portal, and telehealth platform), scheduling an appointment, or providing personal health information, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our services.

2. ABOUT OUR SERVICES

Aatma Medical Marijuana Evaluation is a Florida-based medical practice providing medical marijuana evaluations, consultations, and ongoing patient care through both in-person and telemedicine appointments. Our services are delivered by a licensed Florida physician and include:

Initial Medical Evaluation: Comprehensive in-person assessment required by Florida law (Statute § 381.986) to determine medical marijuana eligibility and provide physician certification to the Florida Office of Medical Marijuana Use (OMMU).

Subscription-Based Ongoing Care: Monthly telemedicine consultations with physician-guided dosing recommendations, strain guidance, treatment plan optimization, and included recertifications.

Follow-up Consultations: Telemedicine appointments available monthly (or as clinically indicated) for patients who have completed an initial in-person evaluation.

Patient Portal Access: Secure, HIPAA-compliant platform for appointment scheduling, medical record access, and physician communication.

3. FLORIDA REGULATORY REQUIREMENTS

Aatma Medical Marijuana Evaluation operates in full compliance with Florida Statute § 381.986 and the Florida Department of Health's Office of Medical Marijuana Use (OMMU) regulations. As a patient, you understand and acknowledge:

Initial In-Person Examination Requirement: Florida law mandates that the first medical marijuana evaluation must be conducted in person with a physician physically present in the same room as the patient. This requirement cannot be waived and is non-negotiable under state law.

Physician Licensure: Our physician holds an active, unrestricted license under Florida Chapter 458 (Medical Practice Act) and has completed all required Florida Physician Medical Marijuana Course requirements.

Telehealth for Follow-Up Only: Subsequent appointments and recertifications may be conducted via secure telemedicine only after an established in-person relationship has been documented, as permitted under Florida House Bill 387.

OMMU Registration: Upon your eligibility determination, the physician will submit your recommendation to the Florida Office of Medical Marijuana Use for official registration. You are responsible for completing any additional state registration requirements.

Payment Terms: Subscriptions are billed annually in advance via secure payment processing. By agreeing to these terms, you authorize recurring charges to your payment method on file.

Cancellation: You may cancel your subscription at any time by providing written notice to Aatma Medical. Cancellation becomes effective at the end of your current billing cycle. No refunds are provided for unused portions of paid subscriptions.

No Refunds for Non-Qualification: If our physician determines you do not qualify for medical marijuana based on your medical evaluation, you will not be charged for the evaluation. If you qualify but elect not to pursue medical marijuana after your evaluation, an administrative fee of $15 applies to cover clinical assessment and documentation time.

5. INITIAL EVALUATION PROCESS

Scheduling: Appointments are scheduled through our HIPAA-compliant Acuity scheduling platform on our website.

Patient Intake Requirements: Prior to your appointment, you must complete:

  • Patient intake questionnaire with complete medical history

  • Medication list and current medical conditions

  • Informed consent and authorization forms

  • HIPAA acknowledgment

Evaluation Duration: Initial evaluations typically require 15-45 minutes and include:

  • Comprehensive medical history review per Florida Statute 381.986

  • Assessment of current medications and potential interactions

  • Physical examination as clinically indicated

  • Discussion of medical marijuana as treatment option

  • Risk-benefit analysis specific to your condition

  • Treatment plan development (if appropriate)

Documentation: The physician will maintain detailed medical records in our secure system as required by Florida law. These records are your property and available upon request in accordance with HIPAA access rights.

6. TELEMEDICINE APPOINTMENTS

Technology Requirements: Telemedicine consultations require:

  • Secure internet connection (wired preferred)

  • Device with video and audio capability (computer, tablet, or smartphone)

  • Private location ensuring confidentiality

  • HIPAA-compliant platform (Doxy.me or comparable service)

Live, Interactive Consultations: All telemedicine appointments must be live, interactive audio and video consultations between you and the physician. Asynchronous consultations or text-only communication do not meet clinical standards and are not permitted as primary consultations.

Patient Responsibilities:

  • Ensure device is fully charged before appointment

  • Log in 5 minutes early

  • Ensure privacy and quiet environment

  • Provide complete and accurate medical information

  • Notify physician of medication changes or adverse effects

  • Attend all scheduled appointments or provide 24-hour cancellation notice

Technical Issues: If technical difficulties prevent completion of a telemedicine visit, the physician may elect to reschedule at no additional cost or to conduct the consultation via telephone if clinically appropriate.

7. PHYSICIAN-PATIENT RELATIONSHIP

Establishment of Relationship: A physician-patient relationship is established when:

  1. You complete and sign informed consent documentation

  2. The physician conducts an initial in-person evaluation

  3. You formally engage in care through our subscription service

Scope of Care: Aatma Medical provides medical marijuana evaluation and ongoing optimization services only. We do not provide:

  • Treatment for acute medical emergencies

  • Comprehensive primary care

  • Mental health treatment or psychiatric services

  • Addiction treatment

  • Prescriptions for controlled substances other than medical marijuana recommendations

Treatment Plan: Your physician will develop a personalized treatment plan including:

  • Recommended marijuana delivery method(s)

  • Approximate dosing guidance based on your condition

  • Expected therapeutic timeline

  • Monitoring schedule and follow-up requirements

  • Alternative treatment considerations

Your Physician: You will work with the same physician throughout your subscription period, ensuring continuity of care and optimization of your treatment plan. If your physician becomes unavailable, Aatma will notify you and facilitate a transition with another qualified physician.

8. PATIENT RESPONSIBILITIES & CONDUCT

You agree to:

Honesty & Accuracy: Provide complete, truthful medical history and current health information. Misrepresenting or falsifying medical conditions to obtain a medical marijuana recommendation violates Florida law and will result in:

  • Immediate termination of services

  • Revocation of any issued recommendation

  • Referral to appropriate legal authorities

  • Potential criminal charges under Florida Statute § 381.986(3)(c)

Compliance with Law: Use your medical marijuana recommendation only in compliance with Florida law. Illegal use, distribution, cultivation, or sale of marijuana is prohibited and violates these terms.

Behavioral Standards: You agree not to:

  • Engage in threatening, abusive, or harassing behavior toward staff

  • Attempt to manipulate, falsify, or alter medical records

  • Attempt to obtain multiple certifications from different physicians

  • Use false identification or provide fraudulent information

  • Abuse platform or portal access

Follow-Up Engagement: Attend scheduled appointments as agreed. Failure to attend three consecutive appointments without cancellation will result in service termination.

Breach of Terms: Any violation of these terms may result in immediate termination of care and referral to legal authorities as appropriate.

9. LIMITATIONS ON LIABILITY & MEDICAL DISCLAIMER

No Emergency Services: Aatma Medical Marijuana Evaluation does not provide emergency medical care. If you experience a medical emergency, contact 911 or proceed to the nearest emergency room immediately.

Limitations on Scope: Medical marijuana evaluation and recommendations are limited to cannabis use for qualifying medical conditions under Florida law. Aatma does not:

  • Guarantee effectiveness of treatment

  • Monitor or manage other medications

  • Provide diagnosis of conditions outside medical marijuana evaluation scope

  • Provide treatment for medication side effects

Assumption of Risk: By engaging in medical marijuana treatment, you acknowledge:

  • Medical marijuana benefits and risks are not fully understood

  • Cannabis use may involve risks including but not limited to: impaired coordination and cognition, impaired driving ability, dizziness, anxiety, confusion, sedation, low blood pressure, dry mouth, and other effects

  • You assume full responsibility for any harm resulting from your use of medical marijuana

  • You assume responsibility for safe use (including not driving while impaired)

Release of Liability: You agree to release, indemnify, and hold harmless Aatma Medical Marijuana Evaluation, its physician(s), staff, agents, and representatives from any and all liability arising from:

  • Your use of medical marijuana

  • Any adverse reactions or side effects

  • Interactions with other medications

  • Your driving or operating machinery while using cannabis

  • Any unlawful use of your medical marijuana recommendation

  • Your violation of these terms

Medical Marijuana Not for Everyone: If the physician determines medical marijuana is not appropriate for your condition or is contraindicated by your medical history, no recommendation will be issued. You will not be charged for this evaluation.

10. PRIVACY, CONFIDENTIALITY & HIPAA COMPLIANCE

HIPAA Compliance: Aatma Medical Marijuana Evaluation is a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). All patient health information is protected under HIPAA Privacy, Security, and Breach Notification Rules.

Your Privacy Rights:

  • Access: You have the right to access and obtain copies of your medical records within 30 days of request

  • Amendment: You may request corrections to inaccurate or incomplete medical records

  • Confidentiality: All health information is maintained confidentially and disclosed only as permitted by law or with your written authorization

  • Breach Notification: You will be notified promptly of any unauthorized disclosure of your health information

  • Complaint: You may file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights if you believe your privacy rights have been violated

Notice of Privacy Practices: A complete Notice of Privacy Practices is provided separately and explains how your health information may be used and disclosed.

Medical Records Retention: Medical records are maintained for a minimum of 7 years as required by Florida law and will be disposed of securely thereafter.

Secure Communication: All telemedicine platforms, patient portals, and electronic communications use encryption and security measures compliant with HIPAA standards.

Third-Party Services: Aatma uses HIPAA-compliant business associates (Doxy.me for telemedicine, Acuity for scheduling, Square for payments). These vendors have signed Business Associate Agreements and maintain the same confidentiality standards as Aatma.

11. FINANCIAL RESPONSIBILITY & PAYMENT

Payment Terms: Subscription fees are due in full annually, billed in advance. Payment is processed through secure payment processing (Square or equivalent).

Accepted Payment Methods: Credit cards, debit cards, and bank transfers (where available).

Insurance: Insurance coverage for medical marijuana evaluations is limited. We recommend contacting your insurance provider to determine coverage. Aatma can provide documentation for insurance claims if applicable, but cannot guarantee reimbursement. You remain responsible for any portion not covered by insurance.

Fees Not Included in Subscription:

  • Cancelled or no-show appointments: $25 fee per missed appointment without 24-hour notice

  • Expedited or priority consultations: Additional fees may apply

  • Medical records copying/transfer: $0.50 per page (Florida standard)

  • Administrative documentation: $15 per document

Financial Responsibility: You are responsible for all charges incurred for services provided. Submitting charges to insurance does not waive our right to seek payment directly from you for any unpaid balance.

Billing Disputes: Contact Aatma within 30 days of charges to dispute bills. Disputes will be reviewed and resolved within 45 days.

Late Payments: Accounts with unpaid balances 30 days overdue may result in:

  • Service suspension until payment is made

  • Referral to collection agency

  • Legal action to recover unpaid fees

No Refunds: Annual subscription fees are non-refundable except as required by law or in cases of medical non-qualification for initial evaluation.

12. INTELLECTUAL PROPERTY & PATIENT PORTAL

Patient Portal License: Aatma grants you a limited, non-exclusive license to access the patient portal for your personal healthcare needs only. You may not:

  • Share login credentials with others

  • Download or reproduce medical records for resale

  • Use portal information for commercial purposes

  • Attempt to access other patients' records

Physician Intellectual Property: All treatment guidelines, protocols, dosing recommendations, and clinical materials are the intellectual property of Aatma Medical and protected by copyright and trade secret law.

Portal Termination: Upon termination of services or at Aatma's discretion, portal access will be revoked. You may request copies of medical records before access termination.

13. TERMINATION OF SERVICES

Aatma May Terminate Services For:

  • Non-payment of fees (30 days past due)

  • Misrepresentation or falsification of medical information

  • Threatening, abusive, or harassing conduct toward staff

  • Three consecutive missed appointments without cancellation

  • Use of recommendation for illegal purposes

  • Violation of Florida medical marijuana laws

  • Patient preference to discontinue

Patient May Terminate Services:

  • By providing written notice of cancellation anytime

  • Cancellation becomes effective at end of current billing cycle

  • Request all medical records before final appointment

Physician May Decline Continuing Care:

  • For therapeutic reasons if clinical relationship cannot be maintained

  • With 30 days' notice and assistance with transition to another provider

  • Emergency termination allowed for safety or legal reasons

Post-Termination Obligations:

  • All outstanding balances remain due

  • Medical records will be maintained per Florida law (7 years)

  • You may request records transfer to another provider

  • Recommendation will remain valid until expiration (unless revoked for legal cause)

14. UPDATES & MODIFICATIONS TO THESE TERMS

Right to Modify: Aatma may update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website unless otherwise stated.

Notification: Significant changes will be communicated to patients via email or notice in patient portal.

Continued Use: Your continued use of services after updates constitutes acceptance of modified terms. If you disagree with changes, you may cancel your subscription.

15. GENERAL PROVISIONS

Entire Agreement: These Terms and Conditions, along with the Notice of Privacy Practices and Informed Consent forms, constitute the entire agreement between you and Aatma Medical Marijuana Evaluation.

Severability: If any provision of these terms is found unenforceable, remaining provisions remain in effect.

Governing Law: These terms are governed by the laws of the State of Florida without reference to conflict-of-law principles.

Jurisdiction & Venue: You agree to submit to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida, for any legal action or proceeding.

No Class Actions: You agree not to participate in class action lawsuits or arbitrations against Aatma Medical.

Waiver: Failure to enforce any provision does not waive that provision or any other provision.

Survival: Provisions regarding confidentiality, liability limitations, payment obligations, and governing law survive termination.

By accessing our services, scheduling an appointment, or providing personal health information, you acknowledge:

  • You have read and understand these Terms and Conditions

  • You agree to be bound by these terms

  • You understand Florida medical marijuana laws and regulations

  • You understand the risks and limitations of telemedicine

  • You authorize Aatma to provide medical marijuana evaluations in accordance with these terms
